The undead legate at Red wyinde in CoS is listed as having SA: death touch 5d6.
Where does this come from I cannot find anything about in in the cos book or the Midnight 2e book?

Thanks for the link! So am I understanding correctly that that it doesn't actually deal 5d6 damage but instead the 5d6 determines if the death touch works? Also on a miss does the effect persist until discharged?

As for your questions:
1. Correct.
2. The descriptive text says "when touched", which I take means it will remain available until a target has been hit.
