The undead legate at Red wyinde in CoS is listed as having SA: death touch 5d6.
Where does this come from I cannot find anything about in in the cos book or the Midnight 2e book?

Death Domain power. Cleric domain, page 186, Player's Handbook. Hypertext SRD link here.

Thanks for the link! So am I understanding correctly that that it doesn't actually deal 5d6 damage but instead the 5d6 determines if the death touch works? Also on a miss does the effect persist until discharged?

You're welcome.

As for your questions:
1. Correct.
2. The descriptive text says "when touched", which I take means it will remain available until a target has been hit.

I am with bleak, it works as a spell-like ability, so discharge at touch. Wink
